Der Protektor ist kein zwingendes Stiftungsorgan. Es liegt in der Gestaltungsfreiheit des Stifters, ob er ein Protektorat einrichtet und welche Rechte er ihm einräumt. Die Errichtung kann bei der Stiftungsgründung oder zu einem späteren Zeitpunkt erfolgen, sofern die Stiftungsurkunde einen entsprechenden Änderungsvorbehalt enthält.
